1) Agreement to Terms

By booking or participating in Kin Movement services, you agree to these Studio Terms and the Risk Warning & Waiver below.

These Terms apply to all services at Kin Movement, including classes, memberships, intro offers, packs, courses, workshops, guest events, personal training, sauna, and any other services we offer.

Acceptance of these terms occurs electronically by ticking the acceptance box and completing purchase or booking through our online booking platform.

These Terms set clear expectations for your participation and protect both you and our business. Please read them carefully.

Minimum age: 18 years. All participants must be adults.

2) Bookings, Attendance & Cancellations

Bookings & Waitlists

All classes require advance booking. If a class is full, join the waitlist—you may be auto-added if a spot becomes available. Check your timetable regularly after joining a waitlist.

Arrival Time

Arrive 5 minutes before class (10 minutes for your first visit). 

Cancellation Policy

  • Free cancellation: Up to 1 hour before class start.

  • Late cancellation (within 1 hour): $5 fee.

  • No-show: $5 fee.

  • Class credits are deducted regardless of attendance.

This policy protects coaches' time and maintains fair access for members on the waitlist.

Disputes

Believe a fee was applied in error? Contact us within 7 days. We'll review your request and respond within 5 business days.

Exceptional circumstances: We may waive fees for medical emergencies, family emergencies, or accidents.

3) Payments

Payment Processing

When you purchase or book services, you authorise Kin (via our booking/payment provider) to charge your saved payment method for:

• Service fees (classes, memberships, packs, etc.).

• Late cancellation and no-show fees.

• Any other applicable fees.

Payment Disputes

Contact us within 14 days if you believe a charge is incorrect. Before initiating a chargeback, please reach out. We're committed to resolving payment issues fairly and promptly.

4) Service Changes

We may adjust class times, coaches, programming, capacity, or operations as needed. Where possible, we'll provide advance notice via email, website, or social media. Changes may occur with less than 24 hours' notice due to illness, emergencies, or unforeseen circumstances.

If a class is cancelled by Kin Movement your class payment credit or will be refunded.

5) Health, Safety & Participation Requirements

Your safe participation requires your active involvement.

Important Medical Disclaimer

We provide movement coaching, not medical advice. Consult your doctor before starting any exercise program, especially if you have medical conditions, injuries, are pregnant, take medications affecting exercise, or have any health concerns.

Before Participating

Consult your doctor if you:

• Have cardiovascular, respiratory, or musculoskeletal conditions.

• Have had recent surgery or hospitalisation.

• Are pregnant or suspect you may be pregnant.

• Have injuries (current or past) that may be affected by physical activity.

• Take medications that may affect your ability to exercise safely.

• Have any physical limitations, disabilities, or health concerns.

• Have been advised by a medical professional to limit or avoid physical activity.

Inform your coach before each class about:

• Health changes.

• New or worsening injuries.

• Pain, discomfort, or limitations.

• Any conditions requiring exercise modifications.

We encourage you to speak with your coach about health concerns. We don't store medical information, but coaches can modify exercises to support your safe participation.

Not disclosing health information puts your safety at risk and may void your waiver protections. When in doubt, disclose.

During Participation

You must:

• Understand your limits and work within them.

Stop immediately if you experience pain, discomfort, dizziness, shortness of breath, chest pain, or concerning symptoms.

• Inform your coach right away.

• Follow coaching instructions and safety guidelines.

• You may modify exercises or stop at any time.

• You acknowledge that coaches may provide hands-on guidance, physical corrections, or manual adjustments as part of instruction, and you consent to such contact for coaching and safety purposes.

Coach's Discretion

Coaches may:

• Request information about your health or fitness status.

• Modify exercises for your safety.

• Restrict certain activities.

• Ask you to stop if they believe it's unsafe.

• Request medical clearance before continuing.

If you disregard safety guidelines, you accept full responsibility for increased risk.

When to Stay Home

Do not attend if you have:

• Active infectious illness (cold, flu, COVID-19, gastroenteritis, etc.).

• Fever, persistent cough, or acute symptoms.

• Open wounds, sores, cuts, or infection risk to others.

• Been advised to isolate or quarantine.

Contact us to pause or reschedule your membership.

Keep your emergency contact information up to date in your profile. We'll only use it in genuine emergencies.

6) Studio Conduct

To maintain a safe, welcoming environment for all members:

Expected conduct:

• Treat everyone with respect and kindness.

• Follow coach instructions and studio rules.

• Use equipment properly, clean after use, return to designated place.

• Maintain appropriate hygiene standards.

• Respect other members' space and personal boundaries.

Prohibited conduct:

• Harassment, discrimination, bullying, or intimidation.

• Aggressive, threatening, or violent behaviour.

• Intoxication or drug use on premises.

• Theft or damage to property.

• Recording others without consent.

• Unsafe behaviour that endangers yourself or others.

• Disruption of classes or studio operations.

Shared Facilities Notice:

Kin Movement provides shared, all-gender bathroom and shower facilities. Shower areas are semi-enclosed.

By using these facilities, you acknowledge and accept this arrangement and agree to use the space respectfully, maintaining appropriate privacy and personal boundaries at all times.

7) Photography & Filming

We may photograph or film during classes for coaching feedback, quality improvement, and marketing (website, social media, advertising).

By participating, you consent to being photographed or filmed and our use of that content.

Marketing Opt-Out

Prefer not to appear in marketing? Email hello@movewithkin.com with "Marketing Opt-Out" in the subject line. We'll take reasonable steps to exclude you from marketing content (though we cannot guarantee you'll never appear).

Do not photograph or film other members without their explicit consent.

8) Privacy & Data Protection

Information We Collect

Name, email, phone, address, date of birth, emergency contact, payment details.

How We Use Your Information

To manage your account, process payments, communicate important information, contact emergency services if necessary, and comply with legal obligations.

Information Sharing

• Bbooking and payment platform.

• Emergency services or medical personnel (if necessary).

• Legal or regulatory authorities (if required by law).

Health Information

We don't routinely collect or store health information. Speak with your coach about injuries or conditions.

Data Retention

7 years from last interaction or as required by law (for financial records, legal obligations, and dispute resolution).

Security

We take reasonable steps to protect your information, including password-protected systems, restricted access to authorised personnel, and secure payment processing through our booking platform.

Access, Correction & Complaints

You may request access to, or correction of, your personal information by emailing hello@movewithkin.com.

If you have a privacy complaint, please contact us in writing. We will respond within a reasonable timeframe and take reasonable steps to resolve the issue.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

9) Refunds & Consumer Rights

Your Consumer Rights

Your rights under the Australian Consumer Law cannot be excluded. 

Our Refund Policy

Change of mind: Generally non-refundable.

Service not provided: Credit returned, or pro-rata refund if service permanently discontinued.

Consumer guarantee failure: We'll offer appropriate remedy as required by law.

Medical circumstances: Contact us with supporting medical documentation; considered on a case-by-case basis.

In exceptional circumstances (medical conditions, serious injury, or documented hardship), we may consider refund requests on a case-by-case basis. Contact us to discuss your situation.

Refund Requests

Email hello@movewithkin.com with "Refund Request" in the subject line. Include:

• Your name and purchase details.

• Reason for request.

• Supporting documentation (if applicable).

We'll respond within 7 business days.

Effective Date: Date of purchase
Governing Law: Tasmania, Australia

Severability: If any part of these Terms is unenforceable, the rest remains in full effect.

Assignment: These Terms are personal to you and cannot be transferred. We may transfer our rights to another entity (for example, if we sell the business), but your rights remain protected.
